Terms of Service

These Terms of Service govern your use of the barenox website and any enquiries or requests submitted through it. They are written to be clear and practical for customers in Ireland who want compost information, guidance, and quotations.

1. Acceptance and eligibility

By accessing or using this website (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Site.

You must be at least 16 years old to submit an enquiry through our forms or to request a quote. If you are under 18, you should involve a parent or guardian when arranging purchases or delivery. We do not knowingly offer services directly to children under 16 through this Site.

If you are using the Site on behalf of a business, organisation, school, community group, or public body, you confirm that you have authority to bind that entity to these Terms. In that case, “you” refers to both you and the entity.


2. Service description

barenox operates an Irish organic compost farm. The Site provides information about our compost products, typical use cases, and general guidance on application. The Site also allows you to contact us to request pricing, availability information, and practical guidance for your project.

The Site is an information and enquiry channel. Unless we explicitly agree in writing, nothing on the Site constitutes a binding offer to sell. Any purchase, delivery arrangement, or supply relationship is formed only when we confirm details with you, including product type, quantity, delivery method, timing, and any applicable charges.

Guidance we provide on the Site or by email is general in nature. Soil conditions vary significantly across Ireland and across sites. You are responsible for evaluating whether a product is suitable for your intended purpose, and for following safe handling and application practices.


3. User obligations

You agree to use the Site lawfully and responsibly. When submitting an enquiry, you must provide accurate contact information and not misrepresent your identity or authority to act for a business or organisation.

You are responsible for your own devices, connectivity, and for maintaining the security of any accounts you use to access your email or other services used to communicate with us. If you suspect your email account has been compromised, you should contact us from a secure address before discussing any delivery or payment details.

You agree not to interfere with the Site’s normal operation, not to attempt to bypass security controls, and not to use automated tools to extract data. We may limit or block access if we detect behaviour that threatens the Site, other users, or our business operations.


4. Intellectual property

The Site, including its text, design, visual layout, icons, images, logos, and underlying code, is owned by barenox or licensed to us. These materials are protected by intellectual property laws and other applicable rights.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Site for your personal or internal business purposes related to evaluating compost products and making enquiries.

You may not reproduce, distribute, publicly display, sell, licence, or create derivative works from any part of the Site without our prior written permission, except where permitted by law (for example, quoting short excerpts with appropriate attribution).

“barenox” and associated branding are trademarks or trade names of barenox. You may not use them in a way that suggests endorsement, partnership, or affiliation without our permission.


5. Prohibited activities

You agree not to engage in any of the following prohibited activities:

  • Unlawful use: using the Site in violation of any applicable law or regulation in Ireland or elsewhere.
  • Scraping and automated access: using bots, scrapers, or automated scripts to extract content, pricing logic, emails, or other data from the Site.
  • Security interference: attempting to probe, scan, or test the vulnerability of the Site; bypassing measures that restrict access; or attempting to gain unauthorised access to any system or network.
  • Malicious code: uploading or transmitting viruses, worms, or any other code designed to harm, disrupt, or alter the Site or any user’s device.
  • Fraud and impersonation: impersonating another person or entity, or submitting enquiries with misleading details intended to obtain goods, services, or information improperly.
  • Spamming: using the Site’s contact channels to send spam, bulk messages, or unrelated solicitations.

If you engage in prohibited activities, we may restrict your access to the Site and may take further action where appropriate, including cooperating with lawful requests from relevant authorities.


6. Disclaimers of warranties

The Site and all content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties and conditions, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that any content will be accurate, complete, or up to date at all times. We may change content, product descriptions, and general guidance without notice.

Any soil or gardening guidance is general and does not replace professional agronomic or horticultural advice tailored to your site. Results depend on soil type, weather, existing nutrient levels, plant selection, application rate, and management practices.


7. Limitation of liability

To the maximum extent permitted by applicable law, barenox will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of (or inability to use) the Site.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or related to these Terms or the Site will be limited to the lower of: (a) the amount you paid to us in the 12 months immediately preceding the event giving rise to the claim, or (b) EUR 100.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Irish law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that the law does not permit to be excluded.


8. Indemnification

You agree to indemnify, defend, and hold harmless barenox, its employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site in breach of these Terms, (b) your violation of any law or regulation, or (c) your infringement of any third-party rights.

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you. In that case, you agree to cooperate with our defence of the claim.


9. Third-party links

The Site may reference or point to third-party resources for general context. If we do, those resources are provided for convenience only. We do not control third-party sites and are not responsible for their content, availability, or practices.

Your interactions with third-party sites are governed by their own terms and policies. You should review those terms before providing personal data or relying on third-party information.


10. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains what personal data we collect, how we use it, and your rights. The Privacy Policy is incorporated into these Terms by reference.

If you submit an enquiry through the Site, you confirm that you are authorised to provide the information you submit (for example, contact details for a business) and that the information is accurate to the best of your knowledge.


11. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Site, are governed by the laws of Ireland, without regard to conflict of laws rules.

Subject to the dispute resolution clause below, you agree that the courts of Dublin, Ireland will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Site.


12. Dispute resolution

Before initiating formal legal proceedings, you agree to contact us and attempt to resolve the issue informally for a period of 30 days. You can start the process by sending a clear description of the concern to the contact details in Section 15.

If the dispute is not resolved within 30 days of written notice, either party may bring proceedings in accordance with Section 11. Nothing in this section prevents either party from seeking urgent injunctive or equitable relief where appropriate.


13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have breached these Terms or if your behaviour creates risk to the Site, other users, or our operations.

Sections that by their nature should survive termination will survive, including Sections 4 (Intellectual property), 5 (Prohibited activities), 6 (Disclaimers), 7 (Limitation of liability), 8 (Indemnification), 11 (Governing law and jurisdiction), 12 (Dispute resolution), and 15 (Contact for legal notices).


14. Modifications

We may update these Terms from time to time to reflect changes to the Site, legal requirements, or our practices. Changes will be effective 14 days after posting the updated Terms on this page, unless a shorter period is required by law or the change is minor and non-material.

By continuing to use the Site after the effective date of the updated Terms, you agree to the revised Terms. If you do not agree, you should stop using the Site.
